Terms of Service

About these terms
These terms describe the website and services offered by Cindy Hernandez through VirtualNotary Pro. Contact cindy@virtualnotary.pro with questions. Before confirming a paid appointment, I will provide the applicable service, price, and policies for review and acceptance. A service request alone does not create a confirmed booking.
Availability and remote appointments
Services marked coming soon or in development are not available for booking until I confirm that all required credentials, technology, and service arrangements are in place. My website describes a remote-first, no-travel client experience. Any published reference pricing for an in-person or location-restricted service is not a promise that it can be performed remotely or is currently offered.
Texas requirements and document eligibility
I perform notarizations only within the scope of my commission and applicable Texas law. For a Texas remote online notarization, I must be physically in Texas; signer location, document type, transaction requirements, and recipient acceptance must also be considered. Not every document or transaction can be completed online. Transactions that require a particular physical closing location, including certain Texas home-equity transactions, require separate eligibility review and cannot be assumed to qualify for remote service.
Your preparation and responsibilities
Provide accurate contact information and complete, properly prepared documents. Confirm with the receiving organization that it accepts the proposed notarization method. Follow my instructions about identification, witnesses, signing, supported file formats, and preparation. Do not sign in advance when the notarial act requires signing in my presence. For remote sessions, have a suitable device, camera, microphone, internet connection, and access to the required verification process.
Identity, willingness, and lawful refusal
I must complete the legally required identity and notarial checks and assess whether the act can lawfully proceed. I may decline or stop a session when requirements are not met, identity cannot be verified, the signer appears unwilling, or another legal or technical issue prevents completion. Payment does not guarantee completion or override legal requirements.
Prices and payment
Published service prices remain subject to the details and eligibility of the request. I will provide an itemized total and disclose applicable third-party or shipping costs before you commit. Notarial charges remain subject to Texas fee limits. No cancellation or no-show fee is created by these terms. Any costs must be lawful and disclosed and agreed before they are incurred. See the Cancellation & Refund Policy.
No legal advice or guarantee of acceptance
I am not an attorney and do not provide legal advice, choose legal forms for you, or determine the legal sufficiency or effect of your document. Notarization does not guarantee document contents, enforceability, recording, lender acceptance, or apostille approval. These statements do not excuse errors in my own notarial work or waive any rights that cannot lawfully be waived.
Privacy, recording, and providers
Information handling and required record retention are described in the Privacy Policy. Remote sessions involve required recording and identity verification. Separate provider terms may apply to tools you use; those will be identified before use. This general website and its intake form are not a secure document vault.
Appropriate use
Do not submit fraudulent requests, impersonate another person, provide false identity information, interfere with the website, or attempt unauthorized access. Use only documents and information you are authorized to provide.
Issues and corrections
If you believe there is an error in my service, contact me promptly so I can review it and arrange an appropriate lawful correction, rescheduling, or refund. Nothing in these terms restricts a right to contact a regulator, seek legal remedies, or exercise nonwaivable consumer or payment rights.
Governing law and updates
Texas law governs these terms to the extent applicable, subject to controlling federal law and mandatory protections that cannot be waived. If a provision is unenforceable, the remaining provisions apply to the extent permitted by law. Updates apply prospectively; I will not retroactively impose new fees or materially change an accepted appointment without the required agreement.
